Luxotel Pte. Ltd., the owner of Curated Wines, (the “Company”, “we”, “us”, “our”) has established these Terms of Service (“Terms”), which govern the access of users (“you”, “your”) and use of the curatedwines.sg website (the “Website”, "Site"), and any information, text, graphics, or other materials uploaded, downloaded, or appearing on the Website (collectively referred to as “Content”). By accessing or using the Website you agree to be bound by these Terms.

General Sales Terms of Service

Under Singapore Law, alcoholic products can only be sold or supplied to persons aged 18 years and above. By using the Website, you certify that you are at least 18 years old.

All prices quoted on the web site are in Singapore Dollars and include taxes unless otherwise stated.

All wine bottles in this store are of size 750 ml unless otherwise explicitly specified. 

The design of the bottle or its label, or the vintage of the wine available for delivery may be different from that shown in the product photo or stated in the product title or description. If you wish, you can seek a confirmation of these specifications by contacting us prior to making a purchase.

Payment can be made through payment instruments specified in the website and is due upon payment gateway approval.

Your order will only be processed by our system when you have completed the online transaction successfully.

Any order made herein shall be governed by and construed in accordance with the laws of Singapore and parties hereto shall be subject to the exclusive jurisdiction of the Singapore Courts.

The Company reserves the right to modify the terms, conditions and notices under which it offers the Site without notice. Your continued use of the Site after any such changes constitutes your agreement to such changes. The Company further reserves the right to change prices and other information on the Site at any time without notice. The posting of prices and other terms of sale shall not constitute a binding order to sell product on such terms.

All Content included in or made available through the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of The Company or its Content suppliers and protected by Singapore and international copyright laws.

In an attempt to provide enhanced value to website visitors, the website may contain links to other sites on the internet that are owned and operated by third party vendors and other third parties (the “External Sites”).

We have no control over these independent policies or actions and are not responsible for the privacy practices or the content of such External Sites.

Your Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

The Company reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Purchase and Payment

You should carefully read the item details page and review information such as price, quantity, billing and shipping address, etc. before confirming your order.

We take no responsibility and assume no liability for any loss or damages to a buyer arising from shipping information and/or payer information entered by the buyer or wrong remittance by the buyer in connection with the payment for the items purchased. We reserve the right to check whether a buyer is duly authorised to use certain payment method, and may suspend the transaction until such authorisation is confirmed or cancel the relevant transaction where such confirmation is not available.

Cancellation of Orders

We understand due to various reasons, cancellation of orders may happen. In the event of cancellation of orders, especially online, only a portion of the total amount will be refunded due to bank or other such charges to each cancellation of orders.

Order and Delivery

Even as our system was created to avoid no stock situation, we cannot guarantee the availability of stock upon confirmation. In such cases, we will contact you and recommend a replacement or you can choose to cancel your order.

Orders made online, will be processed by our staff and they will get in touch with you to arrange for the delivery. All orders will be delivered within 3 business days of it being processed, excluding public holidays.

The delivery must be received by persons aged 18 or above. We reserve the right to request for a valid photo ID for verification.

Return & Refund

You are advised and shall be deemed to have inspected all goods immediately upon receipt and shall notify us within 24 hours of any discrepancies or damage. Failure which, the Company will in its sole discretion, not accord a replacement or refund.

In the event of:

wrong delivery where the delivered products do not match your order, we will arrange for replacement,

breakage of wines in the process of delivering to you, we will arrange for replacement

undrinkable wine, we will arrange for replacement or refund after verification with our team of experts

All wines returned should not be less than half bottle for our verification

Once you report a situation like the above, our experts will investigate and their decisions will be final and binding and no further dispute will be entertained.

We decline all responsibilities to other problems that can occur due to misuse or inappropriate handling and storage of the products.

Force Majeure

Luxotel Pte. Ltd. shall be excused from performance under these Terms of Service if Luxotel Pte. Ltd. is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement under these Terms of Service by reason of: (a) any provision of any present or future law or regulation or order of Singapore, or any countries or territories, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Luxotel Pte. Ltd.

Disclaimer of Warranties and Limitations of Liability

The website is provided by the company on an “as is” and “as available” basis. The company makes no representations or warranties of any kind, express or implied, as to the operation of the website or the information, content, materials, or products included on the website. You expressly agree that your use of the website is at your sole risk.

To the full extent permissible by applicable law, the company disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The company does not warrant that the website, its servers, or e-mail sent from the company are free of computer malfunction, software errors, viruses or other harmful components. The company will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Terms, or your violation of any law or the rights of a third party.
